Terms and Conditions

 

1. General

 
  1. The terms and conditions provided constitutes the basis on the prizes and how to enter the promotion. Any entry that does not comply with these terms and conditions will be invalid.

  2. For the purposes of the Terms and Conditions, Mad Paws Pty Ltd includes all related and subsidiary companies, past, present and future officers, agents, representatives, employees and assigns.

  3. The Promoter is Mad Paws Pty Ltd  (ABN 78 600 835 425) of 62 Birkley Road, Manly NSW 2095.

  4. For the purpose of the Terms and Conditions, a Mad Paws ‘User’ refers to both Pet Owners, Pet Sitters and all other parties that have signed up for the Mad Paws service.

  5. This Promotion is run and administered by Mad Paws Pty Ltd. All the Terms and Conditions presented apply to Mad Paws Pty Ltd.

  6. By entering this competition, participants agree to be communicated to in accordance with Mad Paw’s Privacy policy available at www.madpaws.com.au/privacy.

  7. By entering this competition, participants agree to be communicated to in accordance with Mad Paw’s Terms of Services available at www.madpaws.com.au/terms.

  8. The promotional period starts on April 11, 2016, 9 AM AEST and ends on May 31, 2016, 11:59 PM, AEST.


2. Entry Requirements

 
  1. Entry to the competition is only open to Australian Residents who are 18 years of age or over.

  2. Entrants to the competition are required to be members of the Mad Paws Pty Ltd network, as either a Pet Sitter or a Pet Owner.  

  3. Entry to the competition is free, subject to the term above.

  4. Employees of The Promoter and their immediate families are not eligible to enter the Promotion. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

  5. To enter the competition, Mad Paws Users are required to visit the Mad Paws website and enter the following details:

    1. Answer to question: “who looks after your pet when you go on holidays? Tell us in 25 words or less”

    2. Email

    3. First name

  6. Entrants are required to complete all fields of the registration forms and agree to these Terms and Conditions, for the entry to be valid. Incomplete, illegible or incomprehensible entries will be deemed invalid.

  7. Entrants will become ineligible to win if they ‘unsubscribe’ from the Mad Paws website and mailing list before the announcement of the Prize Winner on June 3, 2016, 2 PM AEST.

  8. Entry is limited to one entry per Mad Paws User.

 

3. Prizes

 
  1. Entering the competition does not guarantee a prize.

  2. The prizes consist of four $500 PETstock Gift Card valid from 12 months from issue date. See card for condition of use. This equals a total prize pool of $2,000 RRP.

  3. Only one prize per User is permitted.

  4. Any ancillary costs associated with redeeming a PETstock Gift Card are not included. Any unused balance of a PETstock Gift Card will not be awarded as cash. Redemption of the PETstock Gift Card is subject to any terms and conditions of the issuer including those specified on the PETstock Gift Card.

  5. The prizes may not be transferred, exchanged or substituted. Prizes are not redeemable for cash, unless otherwise indicated by the Promoter. The Promoter reserves the right to substitute a prize with a prize of equal or greater value due to prize unavailability.

  6. Winners of all prizes will be sent their prizes at an agreed date and time from Mad Paws Pty Ltd.

  7. If requested by the Promoter, winners must sign a legal disclaimer and any other legal documentation, on reasonable terms determined by the Promoter, as a condition of taking any prize.

  8. The Promoter shall not be liable for any costs associated with the prize after delivery.

  9. As a condition of accepting a prize, entrants consent, in the event that they are a winner, to participate in any reasonable winner announcements and promotional activities as requested by the Promoter.

 

4. Judging

 
  1. The Promotion will be judged based on skill and chance plays no part in determining the winner. Entries will be individually judged based on the creativity of their answer to the question “who looks after your pet when you go on holidays? Tell us in 25 words or less”. The winner(s) will be chosen at the discretion of The Promoter.

  2. Judging the Promotion is at the discretion of the Promoter.

  3. Judging will take place at Mad Paws Pty. Ltd. office at 608 Harris St, 2007 Ultimo.

  4. All winners will be notified via email on June 3, 2016, 2 PM AEST. The judging of the competition will happen on June 1, 2016. A final decision will be made no later than 5 PM AEST on June 1, 2016.

  5. If a prize is won by an eligible entrant and they do not claim the prize by September 3, 2016 (3 months after the announcement), that entrant will be deemed to have forfeited the prize and an unclaimed prize redraw will be conducted on September 4, 2016, subject to any direction from the relevant state and/or territory gaming departments. 

  6. The judge’s decision is final in relation to all aspects of this Promotion and no correspondence will be entered into.

 

5. Consent of Entrants and Entries

 
  1. All entries must be original and become the property of The Promoter upon submission. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers and prize suppliers. Entry is conditional on providing this PI. When entering the Promotion, each entrant agrees to be entered into the Promoter’s database. By doing so, the entrant gives consent for their first name, email address and answer to the question ‘Who looks after your pet when you go on holidays? Tell us in 25 words or less’ to be used for promotional and marketing purposes for an indefinite period unless otherwise advised. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at www.madpaws.com.au. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose entrant’s personal information to any entity outside of Australia.

  2. All entrants consent to the use of their name and their written material by the Promoter for the purposes of promoting, publicising or marketing this Promotion, including any outcome of this Promotion, in any media, including but not limited to on the Mad Paws website, Facebook page, Instagram page, for an unlimited period. The opportunity to participate in the Promotion and the chance to win a prize constitutes the entire consideration payable by the Promoter in respect of such uses.

  3. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including first name and email address) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

 

7. Liability

 
  1. Each entrant warrants that the contents of their entry is original and does not infringe the intellectual property rights and copyright laws of any third person.

  2. Each entrant warrants that the use or publishing of any entry will not cause the Promoter to be in breach of any third party’s intellectual property or other rights;

  3. Without limiting any other terms herein, the entrant agrees to indemnify the Promoter for any breach of the above terms 1 to 3.

  4. The Promoter does not take any responsibility for any costs associated with entering and/or accessing the Promotion including and not limited to Internet service provider costs.

  5. The promoter does not take any responsibility for late, incorrectly submitted, corrupt or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise

  6. If for any reason the Promotion is not capable of running as planned due to any reason, including unauthorised intervention, fraud, or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right (subject to any applicable law) in its sole discretion to cancel or modify the Promotion and/or to disqualify any individual who has tampered with the entry or voting process.

  7. In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders its determination, including but not limited to hacking, unauthorised interference, vandalism, power failures, tempests, natural disasters, acts of God, civil unrest or strikes, the Promoter may, in its absolute discretion, cancel or modify the Promotion and/or recommence it from the start on the same conditions (subject to any applicable law).

  8. If the Promoter becomes aware that a prize winner is in breach of any warranty contained in these Terms and Conditions or made subsequently to, the Promoter may deem that prize winner ineligible at its absolute discretion and invalidate their entry.

  9. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

  10. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of:

    1. any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);

    2. any theft, unauthorised access or third party interference;

    3. any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;

    4. any variation in prize value to that stated in these Terms and Conditions;

    5. any tax liability incurred by a winner or entrant; or

    6. use of a prize or attendance at any promotional announcement or event.
